This agreement applies to all services provided through our website. Individuals or legal entities intending to place an order are required to carefully read the entire agreement before making a purchase. This agreement consists of the terms and conditions related to the services provided by AnlikHost Limited Company.
If you do not accept the terms of this agreement, your order will not be processed. By placing an order or making a payment, all customers are deemed to have accepted this agreement. The agreement is transparently presented to you during registration and on our website.
1. Provider and Parties
1.1. This agreement is entered into between the service provider, AnlikHost Limited Company (hereinafter referred to as "Provider" or "AnlikHost"), and the individual or institution specified in the new customer registration section (hereinafter referred to as "Customer"). It governs service purchases conducted through the website owned by AnlikHost (hereinafter referred to as the "Site"), as well as the accounting and invoicing processes related to these transactions under the terms and conditions specified below.
1.2. The parties declare, accept, and undertake the accuracy of the information provided in this agreement.
2. Subject of the Agreement
2.1. This agreement regulates the operations, orders, and communications made by the customer on the website, as well as the permitted and prohibited actions in accordance with the information provided during registration. It also specifies the fees payable to AnlikHost for the services selected by the customer.
2.2. Membership information refers to the details provided by the customer during registration. These details will be used as a basis for transactions, and it is assumed that the customer has entered them accurately, completely, and correctly.
3. Responsibilities of the Agreement
3.1. AnlikHost Limited Company shall provide the services requested by the customer as specified in the order. Upon sending the order confirmation message, AnlikHost acknowledges that the fee has been collected and undertakes to provide the service specified in the order.
3.2. Payment methods and VAT differences are specified during the ordering process, and the customer is obligated to make payments on a monthly or annual basis, as chosen. If the product page includes the phrase "VAT Included," the system will calculate the VAT and complete the order.
3.3. Upon acceptance of the order and completion of the transaction, AnlikHost will provide the necessary credentials (such as control panel, FTP, SQL, and email usernames and passwords) for the service detailed in the customer’s order. The security and confidentiality of these credentials are the responsibility of the customer. AnlikHost shall not be liable for any damages resulting from issues related to these credentials.
4. Term of the Agreement and Delivery of Services
4.1. This agreement takes effect upon the transmission of the order and payment details to AnlikHost through the internet.
4.2. The term of the agreement corresponds to the payment period chosen by the customer for the relevant service during the order process.
4.3. Unless one of the parties notifies the other in writing at least 10 business days before the expiration of the agreement, it will automatically renew under the same terms. However, AnlikHost reserves the right to apply changes to fees.
4.4. Hosting and reseller accounts are activated automatically by the system immediately after payment approval. Services requiring special setup, such as VDS and dedicated servers, are delivered within 24–48 hours, depending on the workload.
5. Fee Details of the Agreement
5.1. The fees for the services are displayed to the customer during the ordering process. If VAT is not included, it will be calculated and shown to the customer before the payment is processed.
5.2. AnlikHost reserves the right to make forward-looking changes to prices and tariffs without prior notice. The customer agrees in advance to any such changes.
5.3. If the fee is specified in a foreign currency, it will be converted to Turkish Lira using the Central Bank's effective sales rate on the invoice date.
5.4. Payment must be completed within 5 business days following the invoice issuance date. Payments can be made via credit card or the bank account details provided by AnlikHost. In the case of a delay, AnlikHost reserves the right to issue a currency difference invoice.
5.5. Services for which payment has not been made may be suspended by AnlikHost and will not be reactivated until payment is completed.
5.6. Refunds are not provided for domain names, hosting, SSL certificates, and server services (e.g., colocation, dedicated servers, or virtual servers).
6. Suspension of Services and Accounts
6.1. AnlikHost reserves the right to suspend or terminate services in cases of non-payment or breaches of the agreement.
6.2. While services are suspended, the customer will not have access to email, FTP, or other related services until the issue is resolved.
6.3. If there is excessive resource usage in hosting and server services, AnlikHost may suspend services with or without prior notice.
7. Termination of the Agreement
7.1. In the event of a breach of the terms of this agreement by the customer, AnlikHost has the right to unilaterally terminate the agreement. In such cases, no refunds will be issued to the customer.
7.2. The customer has the right to terminate the agreement by providing written notice at least 10 days before the expiration date.
8. Jurisdiction and Enforcement Offices
8.1. İzmir Courts and Enforcement Offices shall have exclusive jurisdiction to resolve any disputes arising from this agreement.
8.2. The customer declares and undertakes that they have read, understood, and accepted all the terms and conditions of this agreement.
9. Disputes Regarding Payment of Fees
9.1. If the customer does not make the payment within 7 days following the service request, they will be considered in default. In this case, AnlikHost may issue a currency difference invoice or apply a monthly interest rate of 25%.
9.2. In the event that AnlikHost initiates legal proceedings to collect debts, the customer agrees to pay a penalty of 50% of the outstanding debt, a 10% attorney fee, and all legal expenses.
9.3. The customer accepts that AnlikHost may request precautionary attachment or injunction orders without collateral for debt collection. Any associated bank guarantees or commissions will be borne by the customer.
9.4. If payment is not made within 1 week of the due date, AnlikHost reserves the right to permanently delete the service without refund or reinstatement.
10. Hosting Service Usage Conditions
10.1. Hosting services are designed for equal resource usage among customers. Therefore, a customer may use up to a maximum of 25% CPU resources. If resource usage exceeds this limit, AnlikHost reserves the right to suspend the service.
10.2. Hosting accounts are intended for individual web hosting purposes. They cannot be used for file archiving, bulk email sending, or similar purposes. AnlikHost reserves the right to suspend or terminate such services without prior notice.
10.3. AnlikHost is not responsible for security risks caused by the customer's configurations, such as Chmod 777 settings, or vulnerabilities in the customer's software.
10.4. The customer is responsible for the security of backups taken from hosting services. AnlikHost may perform periodic backups but does not guarantee the integrity or availability of these backups.
11. VDS – Dedicated – Game Server Service Usage Conditions
11.1. VDS and Game Server services have a CPU usage limit of 50%. If this limit is exceeded, AnlikHost reserves the right to suspend the service.
11.2. If the IP addresses used in VDS and Dedicated services are reported for spam or abuse, AnlikHost may suspend the service without notice. Customers are advised to notify AnlikHost within 2 hours if such issues occur.
11.3. The security of the content and software on VDS and Dedicated servers is the customer's responsibility. AnlikHost is only responsible for ensuring server accessibility.
11.4. AnlikHost provides regular backup and maintenance services for servers only upon the customer's request and for an additional fee.
12. Refund Policy
12.1. Hosting services have a refund period of 72 hours (3 days). Refund requests made within this time frame will be considered. Refunds are not applicable for domain names, SSL certificates, or server-related services.
12.2. Refunds are not provided for discounted or promotional products.
12.3. Refunds will be processed within a minimum of 5 days and a maximum of 1 month after AnlikHost approves the request.
13. Service Downtime and Malfunctions
13.1. Servers are electronic devices and may occasionally experience hardware failures. AnlikHost will replace faulty components as quickly as possible but cannot be held liable for delays during this process.
13.2. Data loss due to RAID configuration failures is possible. Customers are responsible for maintaining updated backups.
13.3. AnlikHost is not liable for disruptions caused by data center operations, such as server migrations or IP changes. These processes may result in temporary service outages.
14. Jurisdiction and Final Provisions
14.1. İzmir Courts and Enforcement Offices have jurisdiction over any disputes arising from this agreement.
14.2. The customer acknowledges that they have read, understood, and accepted all the terms and conditions of this agreement.
